Fixed Term Or Periodic Term

Fixed Term

Fixed term tenancies have a start date and an end date and cannot be terminated by notice by either party unless both parties agree. 

Should a tenant request to be released from a fixed term before the end date, the Owner must agree and there is a Fixed Term Break Fee payable to Harcourts Taupo Rentals for this service. 

This fee covers re-advertising the property for rent, undertaking viewings, accepting and processing of applications, drawing up of new paperwork and any other services necessary to secure an acceptable new Tenant.

Periodic Term

A periodic tenancy is for an indefinite period and can be terminated by notice. Tenants are required to provide the landlord with 21 days written notice if they wish to end their tenancy. The landlord must provide tenants with written notice:

  • 42 days if they or any of their family require the property for their own use.
  • 42 days if the property has been sold.
  • 90 days for any other reason.
  • Up to 4 days should be added to the above to provide for service of the Notice.
If tenants wish to vacate during a landlords notice they are still required to provide the landlord with 21 days’ notice.
